§ 1 General

(1) The following Terms & Conditions apply to all contracts between Gudwak GmbH (stickerei.com) and its customers regarding the delivery of custom embroidered textiles and other products.
(2) Deviating or supplementary terms of the customer shall not become part of the contract unless expressly confirmed in writing by us.

§ 2 Responsibility for Online Offer

The online offer of Gudwak GmbH (stickerei.com) is directed at consumers and businesses. The operator of this website is:

§ 3 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order.
(2) By submitting the order, the customer makes a binding offer to conclude a purchase contract.
(3) The contract is concluded upon confirmation by stickerei.com via email or at the latest upon delivery of the goods.

§ 4 Delivery / Shipping

(1) Delivery is made in accordance with the delivery times stated in the shop.
(2) Shipping costs are displayed during the ordering process.
(3) Partial deliveries are permissible if reasonable for the customer.

§ 5 Prices

All prices are in Euro, including the applicable statutory VAT, plus shipping costs.

§ 6 Payment

Payment can be made in advance, via PayPal, credit card or other methods specified in the shop.

§ 7 Retention of Title

The goods remain the property of Gudwak GmbH (stickerei.com) until payment is made in full.

§ 8 Warranty

The statutory warranty rights apply. Deviations in individually manufactured products due to technical or design requirements do not constitute defects.

§ 9 Limitation of Liability

Gudwak GmbH (stickerei.com) shall only be liable for damages in cases of intent or gross negligence. In cases of simple negligence, liability exists only for the breach of essential contractual obligations.

§ 10 Right of Withdrawal for Consumers

(1) Consumers have a statutory right of withdrawal of 14 days.
(2) The right of withdrawal does not apply to goods manufactured individually (e.g. embroidered textiles according to customer specifications).

§ 11 Copyright in Designs

The customer warrants that he holds the rights to the logos, designs or texts submitted. The customer alone is responsible for any legal violations.

§ 12 Indemnification

The customer indemnifies Gudwak GmbH (stickerei.com) from all claims of third parties arising from the use of submitted motifs, logos or texts.

§ 13 Technical and Design Deviations

Gudwak GmbH (stickerei.com) reserves the right to make minor technical changes or deviations in color, shape, or processing as far as they are reasonable for the customer.

§ 14 Data Protection

The collection and processing of personal data is carried out in accordance with the Privacy Policy of stickerei.com and the provisions of the GDPR.

§ 15 Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. Gudwak GmbH (stickerei.com) is not obliged to participate in dispute resolution procedures before a consumer arbitration board but generally declares its willingness to do so.

§ 16 Place of Jurisdiction – Place of Performance – Applicable Law

(1) For contracts with businesses, the place of jurisdiction and performance is the registered office of Gudwak GmbH (stickerei.com).
(2) The law of the Republic of Austria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(3) For consumers, the statutory place of jurisdiction applies.
